The Wearist Terms of Service
These Terms govern access to and use of the The Wearist mobile app, website, and related services.
1. Acceptance of Terms
By using The Wearist, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility
You must be at least 13 years old to use The Wearist. If you are under the age of majority in your jurisdiction, you must use the service with permission from a parent or legal guardian.
3. User Content
- You retain ownership of photos and content you upload.
- You grant The Wearist permission to process uploaded content as needed to provide requested features.
- You represent that you have the rights necessary to upload and use the content.
4. AI Features and Generated Images
The Wearist provides AI-powered recommendations, analysis, and generated outputs. These results are informational, stylistic, and creative in nature and may not always be accurate, complete, or suitable for every context.
Generated images are produced by external providers from the photo you supply. They are approximations: a garment may hang differently in reality, a colour may read differently in daylight, and a face may not be reproduced exactly. Nothing generated in the app is a promise about how something will look on you, and nothing in it is medical, dermatological, or professional advice.
You own the images you upload and, as between you and us, the results generated from them. You may use those results personally and commercially, subject to the rules below and to the terms of the underlying model providers.
What you must not generate. Do not upload photos of other people without their permission, photos of minors in any styling or beauty feature, or explicit, sexual, hateful, or violent imagery. Do not use the app to impersonate anyone or to create misleading images of a real person. We use provider-side safety filtering, and every generated image can be reported inside the app; reports are reviewed by a person, normally within one business day. Accounts used to generate prohibited content can be suspended and the content removed.
5. Purchases, Tokens, and Subscriptions
- AI features use credits. Memberships include a stated credit allowance renewed each billing period, and additional credit packs may be purchased separately.
- Purchases made in the iOS app are billed by Apple through your Apple ID. A subscription renews automatically for the selected period unless you cancel at least 24 hours before the current period ends, and it can be cancelled at any time in your Apple ID settings. Apple charges the renewal within the 24 hours before the period ends.
- Purchases made on our website are billed by Stripe and can be managed through the Stripe billing portal linked from the purchase confirmation page. Website purchases are separate from anything bought in the app.
- The price, billing period, included credit allowance, and renewal terms are shown before checkout.
- Consumable purchases such as credit packs may be non-refundable except where required by law.
- Credits are a licence to use AI features inside The Wearist. They have no cash value, cannot be sold, transferred between accounts, or exchanged for money, and are not a stored-value or payment instrument.
- Credits included with a membership are available while the membership is active. Credits from a separately purchased pack remain on the account until spent or until the account is deleted.
- When a generation fails for a technical reason, the credits spent on it are returned automatically. Refund requests for Apple purchases are handled by Apple.
- Users are responsible for reviewing the purchase terms presented at checkout.
- Some outbound shopping links may be monetized through affiliate or attribution partners. The Wearist may receive compensation if you click or purchase through eligible links.
6. Prohibited Conduct
- Using the service for unlawful, abusive, infringing, or fraudulent purposes.
- Uploading content you do not have the right to use.
- Attempting to reverse engineer, exploit, scrape, or abuse the service.
- Interfering with the integrity or security of The Wearist systems.
- Uploading or generating explicit, sexual, hateful, or violent imagery, images of minors in styling or beauty features, or images intended to impersonate or mislead about a real person.
7. Termination
You may stop using The Wearist at any time. Deleting your data in Profile → Delete removes the profile, wardrobe, plans, conversations and generated looks from the device and erases the credit balance and usage history held for it on our servers; if you have registered an account, deleting the account removes it and cancels any subscription billed by us. Subscriptions billed by Apple must also be cancelled in your Apple ID settings, because deleting an account cannot cancel Apple billing. Reports filed about generated images are kept for safety purposes.
We may suspend or terminate access to The Wearist if you violate these Terms or if continued access would create legal, operational, or security risk.
8. Disclaimer
The Wearist is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, The Wearist and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to use of the service.
10. Changes to These Terms
We may update these Terms as the service changes. The date at the top of this page shows when the current version took effect. Where a change materially reduces your rights, we will give notice in the app or by email before it applies. Continuing to use The Wearist after a change takes effect means you accept the updated Terms; if you do not, stop using the service and delete your data.
11. Governing Law
The Wearist is operated by Grappes LLC, a Wyoming limited liability company. These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, and disputes will be brought in the state or federal courts located in Wyoming. Either party may still seek relief in small-claims court where eligible, and nothing here removes consumer protections that the law of your country of residence grants you and does not permit to be waived.
